This is an English translation provided for convenience. The Slovenian version is the legally binding one; in case of any discrepancy, the Slovenian text prevails.
1. Introduction
These terms of use govern access to and use of the Check Mate application. By registering, signing in or using the application, the user confirms that they have read, understood and accepted these terms of use.
If the user does not agree with the terms, they must not use the application.
2. Purpose of the application
Check Mate is an application intended for connecting users around various activities. It allows users to create activities, sign up for activities, search for activities or users within an approximate area, communicate with other users, edit or delete their own activities, and use other features the application provides.
Activities may be predefined or selected from safe categories, but users may enter their own descriptions, additional information or messages. The user who publishes or sends user-entered content is responsible for it.
3. Age limit
The application may only be used by persons aged 18 or older. By creating an account, the user confirms that they are at least 18 years old.
If we establish or reasonably suspect that the application is being used by a person under 18 years of age, we may restrict, temporarily block or delete the account.
4. User account
To use certain features, the user must create an account and provide truthful, accurate and up-to-date information.
A phone number may be used to create an account, to which the user receives a one-time password, code or another verification method. The purpose of verification is to ensure that each account is linked to one phone number and to reduce the possibility of fake or abusive accounts.
If the user enables push notifications, they can turn them off at any time in the application or device settings. Some notifications may relate to the operation of the application, for example to activities, sign-ups, messages or account security.
The user is responsible for the security of their account, device and access to the application. The user must not allow another person to use their account without Check Mate's permission.
Check Mate may temporarily or permanently restrict, block or delete an account if there is a reasonable suspicion of abuse, a breach of these terms, an infringement of the rights of others, or a breach of the law.
5. Rules of use and prohibited conduct
The user undertakes to use the application lawfully, responsibly and respectfully towards other users. The user must not:
- publish unlawful, offensive, threatening, harassing, discriminatory, violent, sexually explicit or otherwise inappropriate content,
- publish the personal data of other persons without their permission,
- impersonate another person,
- create fake or multiple accounts for the purpose of abuse,
- use the application for spam, fraud, unauthorised advertising or commercial solicitation of other users,
- disrupt the operation of the application or attempt to gain unauthorised access to the system,
- publish activities that would be dangerous, unlawful or misleading,
- use the application in a way that would harm Check Mate, its users or third parties.
6. User content
User content means all information that the user enters, publishes, sends or displays in the application, including activity descriptions, profile data, images, messages and other content.
The user remains the owner of their user content, but grants Check Mate the right to use, display, store, process and transmit that content to the extent necessary for the operation of the application, the display of activities, communication between users, security, the handling of reports and technical support.
Check Mate does not review all user content in advance. Check Mate is not liable for the accuracy, legality, safety, appropriateness or completeness of content published by users. Nevertheless, Check Mate reserves the right to remove, hide or restrict access to content if it considers that it breaches the terms of use, the privacy policy, the rights of third parties or the law.
7. Activity descriptions
When creating an activity, users may enter a description or additional information. The user is solely responsible for the content of the description.
Check Mate may provide preselected activity categories, but is not liable for texts, additional descriptions, arrangements or information entered or created by users.
In activity descriptions, the user must not publish the personal data of other persons without permission, nor offensive, dangerous, unlawful, misleading, discriminatory or otherwise inappropriate content.
8. Chat and communication between users
When communicating with other users, the user must act respectfully and lawfully.
Harassment, threats, insults, sending unsolicited mail, sending misleading or fraudulent messages, sharing the personal data of third parties without permission, and sending content that breaches the law or the rights of others are prohibited.
Check Mate may handle user reports and, where necessary, review relevant communication to the extent required for security, the prevention of abuse, the protection of users or compliance with legal obligations.
9. Reporting and blocking users
The user may report inappropriate content, suspected abuse, a fake account, a dangerous activity, harassment or another breach via the feature in the application, where available, or by email: [email protected].
If the application supports blocking users, the user may block another user. As a rule, a blocked user cannot send messages to the user who blocked them, or access features restricted by the block.
In response to reports, Check Mate may take measures such as a warning, removal of content, restriction of features, a temporary block or permanent deletion of the account.
10. Location and meeting in person
The application may help find activities or users within an approximate area. The user understands that using the features for activities and meetings may involve interaction with other people.
The user is solely responsible for their own safety when arranging and participating in activities. We recommend that users meet in public and safe places, that they do not share sensitive personal data with strangers, and that they use their own judgement.
Check Mate does not guarantee the behaviour, identity, intentions, reliability or safety of other users.
11. Deleting and editing activities
The user may edit or delete activities they have created, to the extent the application allows.
Check Mate reserves the right to delete or restrict an activity if it breaches the terms of use, the law, the rights of third parties or the application's safety rules.
12. Limitation of liability
The application is made available to users as is, and according to the features currently available. Check Mate strives for safe, reliable and high-quality operation of the application, but does not guarantee that the application will always work without errors, interruptions or technical difficulties.
Check Mate is not liable for content created by users, the conduct of users inside or outside the application, arrangements between users, cancellations, changes or irregularities of activities, damage arising from the use of information entered by other users, technical difficulties, or events beyond Check Mate's reasonable control.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
13. Intellectual property rights
The Check Mate application, its design, name, logo, features, program code, graphic elements and other elements are protected by the relevant intellectual property rights, unless stated otherwise.
The user must not copy, modify, distribute, sell, lease, reverse engineer or otherwise misuse the application or parts of it without prior permission.
14. Availability and changes to the application
Check Mate may occasionally change, improve, restrict or discontinue individual features of the application. It may also temporarily suspend access to the application for maintenance, security, technical or other justified reasons.
15. Termination of use
The user may stop using the application at any time and delete their account in the application settings.

Check Mate may temporarily or permanently restrict a user's access if the user breaches the terms of use, the law, the rights of others or the security of the application.
16. Changes to the terms of use
Check Mate may update these terms of use from time to time. Users will be informed of material changes, for example in the application, by email or by publishing an updated document.
If the user continues to use the application after the amended terms take effect, they are deemed to accept the amended terms.
17. Governing law and dispute resolution
These terms of use are governed by the law of the Republic of Slovenia, except where applicable legislation provides otherwise.
We will first attempt to resolve any disputes amicably. If an amicable solution is not possible, the competent court in the Republic of Slovenia has jurisdiction to resolve disputes, unless applicable legislation provides otherwise.
